IMMIGRATION COURT

Immigration Court proceedings are a legal proceeding in which individuals who are illegally present in the US, or are loosing their legal status or citizenship, are required to present their cases either to keep them or find other remedies.

Immigration court proceedings are similar to a judicial proceeding, and require legal representation by an attorney. Only an attorney would know the requirements, process, and remedies available to the person subjected to such proceedings.

Not everyone that is subjected to immigation court proceedings will be deported. Some people whom qualify for any of the remedies available can request them. The remedies are usually cancelation of removal, asylum, or the reinstatement of the lost status, among others. Other remedies, for those whom do not qualify for any other, are voluntary departure or "fast" removal. An attorney or lawyer will know which remedies you qualify for, how to request them, and the method to use to help you acquire it.

Even though some people might qualify to remain in the United States permanently, others might be kept in the United States temporarily. Each case is different, there is no "cookie cutter" rule that applies to all.

IMMIGRATION BOND

Immigration bonds only occurr, and can be requested or granted, once the person detained by immigration is under the jurisdiction of immigration. Therefore, those whom have been detained by the police and have pending criminal proceedings by the State of Federal government must wait untill the end of such proceedings for the immigration bond to apply.

A person can have a valid, court approved, bond from the State or Federal Court; and still will not be released from detention if the person has a pending "immigration detainer". An immigration detainer is an order from immigration that requires the State or Federal jail to not release the person because it has pending immigration proceedings after the state or federal government ends its judicial proceedings. It is similar to being the next designated bat in a baseball game; once the state or federal government finishes it's case, then the next one is immigration.

IF THE PERSON IS IN JAIL AWAITING CRIMINAL PROCEEDINGS FROM THE STATE OR FEDERAL GOVERNMENT, DO NOT PAY ANY STATE BOND IF THE PERSON ALSO HAS AN IMMIGRATION DETAINER. Even if you pay the state or federal bond the person will not be released from jail.

A LOANER MUST NOT FILE ALSO THE BOND FOR YOU, SINCE YOU WILL BE PAYING THE PRINCIPAL TWICE TO HIM SINCE THE BOND AMOUNT RETURNS ALMOST COMPLETELY TO THE ONE WHOM FILED IT; IN THIS CASE THE SAME PERSON THAT LOANED YOU THE MONEY. IF YOU HAVE TO ASK FOR MONEY LOANED TO PAY FOR THE BOND THEN: GET THE MONEY AND GO TO AN ATTORNEY TO FILE THE BOND. THIS WILL RETURN THE BOND PAYMENT TO YOU ALMOST COMPLETELY.
